1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the Caffeine Aotearoa New Zealand Startup Databank at databank.caffeinedaily.co (the "Service"), operated by Caffeine ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

• The Service is private and access-restricted. Access is granted only to authorised users.
• You must sign in using an approved authentication method (Google sign-in or email/password) to access the Service.

• We may suspend or revoke access at any time, at our discretion, including where we believe these Terms have been breached.

• Use the Service for any unlawful purpose or in breach of any applicable law, including the New Zealand Privacy Act 2020.
• Copy, scrape, harvest, extract, redistribute, resell, or republish the database or any substantial part of it, except as expressly authorised by us.
• Use automated means to access, query, or extract data from the Service without our written permission.
• Attempt to circumvent, disable, or interfere with the Service's security or access controls.
• Use any personal information obtained through the Service to contact, market to, or harass individuals in breach of applicable law.
• Use the Service to build or train a competing product or database.

4. Intellectual property

The Service, including its compilation, structure, design, and presentation of data, is owned by Caffeine and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service or its contents. Underlying factual information may be drawn from public sources; our rights relate to the compiled and presented database and the Service as a whole.

5. Accuracy of information

• The Service compiles information about New Zealand startups from public sources, and uses automated tools to verify and enrich it. While we take reasonable care, we do not warrant that the information is complete, accurate, current, or error-free.
• Information is provided for general informational purposes only and should not be relied upon as the sole basis for any decision. You are responsible for independently verifying any information before relying on it.

6. Personal information in the database

The Service contains information about companies and individuals associated with them, compiled from public sources. Our handling of personal information is described in our Privacy Policy. If you are an individual whose information appears in the database and you wish to access, correct, or request removal of that information, please refer to the Privacy Policy for how to contact us.

7. Disclaimers

These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the New Zealand courts.
